On 30 December 2025, Grupa Azoty Polyolefins filed a statement of claim in arbitration proceedings with the Vienna International Arbitral Centre (VIAC) at the Austrian Federal Economic Chamber against Hyundai Engineering Co., Ltd. The dispute concerns the performance of the contract dated 11 May 2019 for the comprehensive execution of the Polimery Police Project. The claim covers demands with a total value of up to EUR 2.98 billion, arising — in the Company’s view — from the contractor’s failure to perform its contractual obligations, which resulted in the project not being completed.
The statement of claim includes demands for the payment of contractual penalties for delays in project execution and related to Grupa Azoty Polyolefins’ withdrawal from the contract for reasons attributable to the contractor. The claim also seeks compensation for losses incurred by Grupa Azoty Polyolefins as a result of improper performance of the contract by the contractor. In addition, the claim requests that the Arbitral Tribunal order the contractor to remedy defects in the works and in the supplied materials, equipment and documentation, or to deliver items free from defects.
‘We consistently maintain that the Polimery Police Project was not completed within the agreed timeframe and for reasons attributable to the contractor, Hyundai Engineering. As a result, the Company has incurred significant financial losses. Filing the arbitration claim became necessary in view of the contractor’s failure to perform the contract,’ commented Andrzej Skolmowski, President of the Management Board of Grupa Azoty. ‘In August, we informed the market about the rejection of the contractor’s claims, as well as about Grupa Azoty Polyolefins’ withdrawal from the contract for the comprehensive execution of the project for reasons attributable to the contractor, and about the imposition of contractual penalties. At the same time, we challenge the effectiveness of the contractor’s subsequent declaration of withdrawal from the same contract. In our assessment, there were no legal or factual grounds for such a declaration, particularly as at the time it was made the contract was no longer in force,’ added President Skolmowski.
On 29 December 2025, Grupa Azoty Polyolefins received a statement of claim filed by Hyundai Engineering Co., Ltd. with VIAC. The contractor seeks claims against Grupa Azoty Polyolefins in connection with the execution of the Polimery Police Project and its own declaration of withdrawal from the contract dated 11 May 2019 for the comprehensive execution of the project. Grupa Azoty Polyolefins does not recognise the claims covered by Hyundai Engineering’s statement of claim, either as to their merits or as to their amount. The Company will submit its response within the deadline set by VIAC, presenting its position on the asserted claims, and will continue to participate consistently in the arbitration proceedings in order to protect its interests.
